Terms of Use

The purpose of these general conditions (hereinafter “the General Conditions”) is to govern the relations between the customer (hereinafter “the CUSTOMER”) and the company operating the residence for which the CUSTOMER makes a reservation (hereinafter , under the brand QUARTIER LIBRE, “QUARTIER LIBRE”) and whose name and contact details appear in the list attached to the General Conditions and in the reservation summary.

1. Contractual documents - Order of precedence

1.1 The relations between QUARTIER LIBRE and the CUSTOMER are governed by the General Conditions, supplemented by their appendices (the description of the services – hereinafter “the Description of the Services” and the scale of the prices invoiced to the CUSTOMER in the event of degradation / deterioration or even if objects and / or furniture are missing in the apartments), as well as by the reservation summary on which the rate applied and any special conditions linked to the rate chosen appear in particular. (the payment terms, on the one hand, and the cancellation and modification conditions – hereinafter the “Cancellation and modification policy”, on the other hand). All of these documents constitute the entire contract (hereinafter “the Contract”).

In the event of any contradiction between these various documents, the order of precedence will be as follows: (i) the General Conditions, (ii) the reservation summary, (iii) the appendices to the General Conditions.

2. Prerequisites

Booking an apartment with QUARTIER LIBRE is reserved for individuals of legal age and legal capacity. By booking an apartment with QUARTIER LIBRE, the CUSTOMER expressly declares that these conditions are met.

3. Reservation procedures

3.1 Reservations can be made on the QUARTIER LIBRE website according to the following process and subject to the availability of the desired apartment (s):

The CUSTOMER chooses the residence, specifies the dates of his stay, chooses the type and number of apartment he wishes to reserve and chooses from the proposed daily rates then validates his choice after having read the full description of the apartment (s). corresponding apartment (s), rates, services included in these rates, payment terms and Cancellation and Modification Policy;

He is then invited:

To fill out a form allowing (i) the taking into account of his reservation. The CUSTOMER guarantees the veracity and accuracy of the information given on this occasion; Where

To contact the residence concerned by email or telephone, in the event of a reservation request for more than 9 apartments on the same dates. Indeed, these general conditions are not applicable in such a situation. Special conditions for group bookings will then be communicated by the residence before the booking is confirmed.

To proceed with the reservation, the CUSTOMER must:

Select the type of apartment and the desired rate which can be flexible (cancellable and modifiable) or non-refundable;

Select the desired additional options (the pricing of each of these options is indicated in the reservation form)

The CUSTOMER must validate his reservation including the options chosen at the displayed price.

The CUSTOMER then accesses a page where he is invited to:

Fill in the contact details required for the reservation,

To complete his payment information.

This page also contains information on payment terms, as well as the Cancellation and Modification Policy.

The CUSTOMER is invited to confirm his reservation request by validating the page, after having read and accepted the General Conditions including the Description of Services.

After validation, the CUSTOMER accesses a page containing a summary of his reservation.

If the reservation request has been taken into account, the CUSTOMER receives an email to the email address indicated in the form above, confirming his reservation and communicating the General Conditions including the Description of Services. and the Cancellation and Modification Policy.

3.2 The reservation can be made by the CUSTOMER by telephone. To do this, he directly calls the number indicated on the QUARTIER LIBRE website for this purpose and by following the following procedure:

The CLIENT indicates to the QUARTIER LIBRE contact person the chosen residence, the number of apartments and the type of apartment he wishes to reserve, specifies the dates of his reservation and chooses from the proposed daily rates. He validates his choice after having received, from his contact person QUARTIER LIBRE, the information concerning the complete description of the corresponding apartment (s), the prices, the services included in these prices, the payment conditions. associated with the rates, as well as the Cancellation and Modification Policy.

He is then invited to provide his name and contact details, including an email address as well as information corresponding to a bank card whose expiry date will not be exceeded at the time of the CLIENT’s stay at the residence in order to guarantee and pay for their reservation during their stay or to prepay for their reservation, if applicable.

After validation, the CUSTOMER is informed of the proper consideration of his reservation request by receiving an email to the email address indicated by telephone confirming his reservation and communicating the General Conditions including the Description of Services. . and the Cancellation and Modification Policy.

3.3 The reservation can be made by e-mail sent to QUARTIER LIBRE by the CUSTOMER according to the following process:

The CUSTOMER indicates in his email, the chosen residence, the number of apartments and the type of apartment he wishes to reserve and specifies the dates of his reservation.

Depending on availability, QUARTIER LIBRE sends the CUSTOMER an offer containing the proposed daily rates, the General Conditions including the Description of Services, the payment terms associated with the rates, as well as the Cancellation and Modification Policy.

The CLIENT confirms his choice by return e-mail, after having read the full description of the corresponding apartment (s), prices, services included in these prices (such as Internet access from the or the apartment (s) and breakfast), the General Conditions and the Cancellation and modification policy linked to the chosen rate, attached in the offer sent by QUARTIER LIBRE by email.

In order to finalize his reservation, the CUSTOMER is then invited to contact by telephone the residence in which he wishes to reserve an apartment. The CLIENT provides the QUARTIER LIBRE contact with his name and contact details as well as information corresponding to a bank card whose expiry date will not be exceeded at the time of the CLIENT’s stay at the residence in order to guarantee and pay for his reservation. during his stay or to proceed, if necessary, to the prepayment of his reservation.

After validation, the CUSTOMER is informed of the proper consideration of his reservation request by receiving an email to the email address indicated by telephone confirming his reservation and communicating the General Conditions including the Description of Services. . and the Cancellation and Modification Policy.

3.4 Depending on the residences, for certain periods of the year, a minimum reservation period may be required. Information relating to the subjects concerned and the minimum reservation period communicated on simple request by telephone.

3.5 All reservations are personal and may in no case be transferred to a third party, whether for free or for a fee or for commercial purposes.

4. Stay at the residence

4.1. The CLIENT undertakes to use the apartment allocated to him and more generally all the equipment of the residence in a reasonable manner, in compliance with the regulations in force, good morals and public order.

4.2. The CUSTOMER is responsible towards QUARTIER LIBRE for any damage caused during his stay, as well as for any object or furniture belonging to the residence which is missing at the end of his stay.

If QUARTIER LIBRE should notice a deterioration or if an object or an element should be missing because of the CLIENT, QUARTIER LIBRE will be entitled to re-invoice the sum corresponding to the damage caused within 48 hours of leaving the residence. , according to the price list attached to the General Conditions.

QUARTIER LIBRE reminds that its residences are non-smoking. The fact of smoking in the common areas and / or the apartments constitutes a degradation. QUARTIER LIBRE will, in this case, be entitled to re-invoice the sum corresponding to the damage caused, according to the price list available in the appendix hereto.

4.3. In the event of behavior contrary to good morals or public order, QUARTIER LIBRE may require the CLIENT to leave the residence immediately, without the latter being able to claim any reimbursement or compensation.

4.4. If one or more minors occupy apartments reserved by the CLIENT, the latter undertakes that at least one adult is present in each of the reserved apartments.

4.5. The CUSTOMER undertakes to:
Use the safe in your apartment for all valuables and sums of money of a value less than or equal to 2,000 euros or failing that, to be deposited in the central safe of the residence, it being specified that the the total cumulative value of the objects stored in the safe in his apartment may not exceed 2,000 euros;

Deposit in the central safe of the residence, accessible from 9:00 a.m. to 6:00 p.m., objects and sums of money whose value is greater than 2,000 euros, as well as those that lead to exceeding the maximum cumulative value of 2 000 euros for items placed in the safe in his apartment;

Any breach of these obligations will be considered gross negligence on the part of the customer.

The CUSTOMER is also informed that he must be able to present the bank card he is using to proceed with the reservation of the apartment.

4.7. The CUSTOMER can enter and leave the residence 24 hours a day (it being specified that depending on the residence, during certain time slots, an entry control system may be set up). The CUSTOMER is informed that in the event of loss or theft of the electronic key, he may obtain a duplicate from the residence. For security reasons, the CUSTOMER will be required to present a valid identity document to obtain this duplicate.

4.8. The apartments can be occupied by the CLIENT from 4 p.m.

4.9. Unless they benefit from the applicable stipulations in terms of early arrival or late departure (see article 4.10 for more details), the apartments must be vacated by the CLIENT before 11:00 am on pain of being charged an amount equal to € 100 including tax. .

These sums are taken directly from the CUSTOMER account corresponding to the bank card number indicated to QUARTIER LIBRE during the reservation or from the bank reserve.

4.10. Early arrival – Late departure: subject to availability, the CUSTOMER may request access to an apartment before 4:00 p.m. on the day of his arrival or to keep his apartment after 4:00 p.m. This service must be subscribed on site with the teams of the residence available the payment of an additional sum and subject to availability. The applicable rates indicated on the QUARTIER LIBRE Site.

4.11. The details of the services included in the price of the night and the services invoiced in addition appear in the appendix to the General Conditions.

4.12. As part of the use of Internet access, whether wired or Wi-Fi, the CUSTOMER undertakes to comply with the Conditions of Use for Internet access which are communicated to him during his first connection and which can also be consulted at the reception of the residence.

4.13. No animal will be allowed in the premises. Any breach of these obligations will be considered gross negligence on the part of the customer.

The CUSTOMER staying at the residence with his pet is also informed that the cleaning of his apartment cannot be carried out if the animal is there during the passage of the maintenance team.

5. Prices - Terms of payment

5.1. The CUSTOMER is informed of the prices of the subscribed services, delivered at the conclusion of the Contract by consulting the QUARTIER LIBRE Site.

The prices indicated on the QUARTIER LIBRE Site are expressed in euros. They include VAT but not the tourist tax (personal and daily tax), the amount of which varies according to the geographical location of the residence. The price indicated in the booking confirmation mentioned in article 3 includes VAT but does not include tourist tax. The amount of the tourist tax appears on the detail of the booking confirmation for information, its amount being subject to regular changes. Any modification of the taxes in force or the introduction of new taxes after the reservation will be reflected in the total price paid by the CUSTOMER.

5.2. The prices indicated during the reservation are per apartment, for one night and within the maximum limit of the number of occupants indicated during the per apartment (excluding children under twenty-four (24) months and with the possibility of addition of a cot, free of charge).

5.3. Depending on the residences and the periods concerned, different types of prices may be offered to the CUSTOMER. The type and conditions of application of the different rates offered for the apartment in the residence chosen by the CUSTOMER are detailed on the QUARTIER LIBRE website and included in the Cancellation and Modification Policy.

5.4. Depending on the type of rate chosen by the CUSTOMER when booking, the price of the night (s) reserved must be paid by the CUSTOMER as follows:

Reservations without the possibility of free modification and cancellation require a prepayment. In this context, the price of the reserved night (s) must be paid by the CUSTOMER in full at the time of booking. In this case, the sums due are taken directly from the bank account corresponding to the bank card whose contact details were provided by the CUSTOMER at the time of booking, after validation of the booking by QUARTIER LIBRE;

For reservations with the possibility of modification and cancellation, the price of the entire CUSTOMER’s stay will be charged, from the CUSTOMER’s arrival at the residence. In this case, the sums due are taken directly from the bank account corresponding to the bank card whose contact details were provided by the CUSTOMER at the time of booking.

5.5 Any extras and / or compensation due to damage or missing items / furniture will also be taken directly from the bank account corresponding to the bank card whose contact details were provided by the CUSTOMER at the time of booking.

In this regard, QUARTIER LIBRE informs the CUSTOMER that his bank details are kept from the validation of his reservation. QUARTIER LIBRE reserves the right to use this data after the end of its stay through payment and deposit platforms and in accordance with their general conditions of use.

The CUSTOMER is informed in advance of the details and amount of withdrawals that will be made from his account in the event of deterioration noted by QUARTIER LIBRE at the end of his stay. With regard to extra consumption, a summary note is sent to the CUSTOMER by email.

5.6. QUARTIER LIBRE may modify the prices of the various apartments at any time without this modification having any consequences for the CUSTOMER who will, in any event, be billed the price in force on the day of his reservation, unless there is a modification of the taxes in force or introduction of new taxes, as provided for in article 6.1 of these General Conditions.

QUARTIER LIBRE may also modify the rates for additional services. The prices applicable for these will be those on the day of their order by the CUSTOMER.

6. Modifications - Cancellation

6.1. In accordance with the provisions of article L.221-28 of the Consumer Code, the CUSTOMER is informed that he does not have the right of withdrawal provided for by article L.221-18 of the same code.

6.2. For each stay reservation, the terms of cancellation and / or modification of the reservation. are detailed in the Cancellation and Modification Policy specific to the chosen rate, which is recalled in the booking confirmation.

6.3 When the CUSTOMER has booked overnight stays without the possibility of cancellation and / or free modification, cancellation is not permitted. The commitment of the parties will be considered firm and final and the CUSTOMER will not be able to obtain any reimbursement of the sums paid as a prepayment on the day of the reservation. Modification of dates is not permitted and is considered a cancellation.

6.4 When the CUSTOMER has reserved a night with the possibility of modification, the CUSTOMER can freely change the date of this night or the type of apartment until 5 days before the day of the start of his stay at the residence, subject to the availability of apartment in this residence. In this case, the rate invoiced to the CUSTOMER will be that in force, at the time of the modification, for the new dates and the new type of apartment chosen by the CUSTOMER.

When the CUSTOMER has booked an overnight stay with the possibility of cancellation and modification, the following conditions apply:

In the event of cancellation before 5 days before the day on which the CLIENT’s stay at the residence begins, no amount will be charged to the CLIENT;

If the cancellation occurs after 5 days before the day of the start of the stay, this late cancellation will result in the invoicing of the total price of the night in question. This amount will be taken directly from the bank account corresponding to the bank card whose contact details were provided by the CLIENT when making their reservation. If, however, this debit proves impossible for any reason whatsoever (and in particular if the bank card in question was no longer valid), the CUSTOMER agrees to pay the amount due by another means of payment accepted by the residence.

In the event of cancellation during the CUSTOMER’s stay, the CUSTOMER may not claim any reimbursement for the canceled night (s), the full amounts paid at the start of his stay in application of article 6.4. remaining acquired in QUARTIER LIBRE.

These rules are applicable except in cases of force majeure within the meaning of Article 11 or specific conditions specified in the Cancellation and Modification Policy specific to the chosen rate.

6.5 Except in cases of force majeure in application of article 11, if the CUSTOMER does not show up after 4 a.m. on the first day of his reservation (“no show”).

If the nights have been booked without the possibility of free modification or cancellation, the CUSTOMER will not be entitled to any refund or any compensation.

If the nights have been booked with the possibility of cancellation or modification, the total amount of the reservation will be directly debited from the bank account corresponding to the credit card whose contact details were provided by the CUSTOMER when booking and any nights additional reservations will be canceled free of charge, unless otherwise indicated in the Pricing Conditions.

In any case, unless the CUSTOMER has previously informed QUARTIER LIBRE by email or telephone before midnight that he could not be present before the deadline for arrival but that he nevertheless intended to return to the residence later and take possession of his apartment (s), the CUSTOMER is informed that QUARTIER LIBRE will put his apartment (s) up for sale.

6.6. If by extraordinary circumstances and except in the event of force majeure, QUARTIER LIBRE should not be able to ensure the booked reservation, it will offer the CLIENT, at the latter’s choice, either the reimbursement of sums already paid, or rehousing in a establishment of at least equivalent category and located nearby (QUARTIER LIBRE bearing the possible difference between the price of the apartment initially reserved by the CUSTOMER with QUARTIER LIBRE and the price of the apartment in the new establishment proposed by QUARTIER LIBRE).

6.7 The cancellation and modification procedures are as follows:

when the CUSTOMER wishes to modify his reservation, the reservation can be modified on the QUARTIER LIBRE Site or at the residence concerned, by email or telephone, under the conditions described in 7.3 and 7.4 above.

7. Liability - Complaints

7.1. The CUSTOMER is solely responsible for the choice of the services he wishes to book and their suitability for his needs and QUARTIER LIBRE will not be responsible in this regard.

7.2. The CUSTOMER is informed that QUARTIER LIBRE is not able to ensure that the apartment (s) assigned to him / her will be strictly identical to the photographs of the type of apartment (s) reserved appearing on the FREE QUARTER Site. Indeed, within the same residence, variations can exist between the various apartments of the same type, in particular in terms of format of the apartment, arrangement of furniture, colors or in the event of change of furniture or renovations. No claim can therefore be made by the CUSTOMER, unless the differences invoked are substantial.

7.3. Any complaints from the CUSTOMER must be made to the residence staff and, if the CUSTOMER considers that no satisfactory solution has been found, must be sent by registered letter with acknowledgment of receipt to the CUSTOMER Service whose contact details appear. in Article 10 within a maximum period of thirty (30) days from the end of the CLIENT’s stay in the residence in question.

9. Force majeure

No failure or omission by either party in the performance of its obligations under the Contract may be considered as a failure by that party to comply with its contractual commitments in the event that this failure or omission is due to an event of force majeure, as defined by the case law of the Plenary Assembly of the Court of Cassation. Force majeure will only release the party invoking it from its contractual obligations to the extent and during the time it is prevented from performing them.

10. Personal data and cookies

10.1. The personal data of the CLIENT collected by QUARTIER LIBRE are processed within the meaning of the amended law of 6 January 1978 relating to data processing and freedoms for the purposes of executing the Contract, in particular management of the reservation. , sending information, as well as payment and billing operations.

The processing of personal data carried out by QUARTIER LIBRE is declared to the CNIL. The personal data of the CUSTOMER is kept for a period necessary for the performance of the service and the monitoring of the commercial relationship. The personal data of the CLIENT necessary to establish proof of a right or a contract will also be kept for the period necessary to allow QUARTIER LIBRE to comply with its legal and / or regulatory obligations.

Credit card data is kept for the time necessary for the performance of the Contract. In addition, they may be kept in an intermediate archive for proof purposes for a period of 13 months, depending on the debit date or 15 months in the case of deferred debit payment cards, it being specified that they may only be used. ‘in case of dispute.

10.2. The personal data of the CLIENT collected by QUARTIER LIBRE must be communicated to third parties (in particular the manager of the reservation platform and the company in charge of the secure payment site) so that the services can be provided. Some of these third parties may be located abroad but still within the European Union. These third parties may only use this data for the same purposes. The third parties have undertaken to take all the necessary security measures to guarantee the confidentiality of the CUSTOMER’s personal data.

10.3. QUARTIER LIBRE may use the CUSTOMER’s personal data for its own marketing operations by sending it, by any means whatsoever and in particular by email, information on its products and services unless the CUSTOMER expressly opposes when communicating personal data or subsequently by writing to the CUSTOMER Service whose contact details appear in article 10 or by electronic means by sending an email to contact@qlsaintgeorges.com.

With regard to commercial prospecting operations intended for the CUSTOMER, QUARTIER LIBRE will keep its data for a period of 3 years from the end of the commercial relationship.

For the purposes of the execution of the Contract, QUARTIER LIBRE may need to collect the CUSTOMER’s telephone number. 10.4. The CUSTOMER has the right to access, modify, rectify, oppose and delete personal data concerning him, as well as a right to define directives relating to the fate of his personal data. after his death. The CUSTOMER may also request the communication of his personal data in an open and machine-readable format in order to be able to reuse them for personal purposes and, if necessary, transmit them to the organization of his choice. He can exercise these rights by writing to the CUSTOMER Service, the contact details of which appear in Article 10.

10.5. The reservation procedure and navigation on the QUARTIER LIBRE Site may lead to the installation of cookies in order to memorize the CUSTOMER’s identifiers and thus allow them direct access to their personal account. The CUSTOMER can nevertheless deactivate these cookies if he wishes at any time, through the settings of his browser.

10.6. QUARTIER LIBRE takes all necessary measures to ensure the protection and confidentiality of personal data transmitted to it by the CLIENT.

10.7 These QUARTIER LIBRE General Conditions of Sale are supplemented by:

– Specific mentions of information appearing on the collection forms.

– A cookie processing policy.

11. Miscellaneous

11.1. By express agreement between QUARTIER LIBRE and the CUSTOMER, e-mails and text messages exchanged for the execution of the Contract will have probative value.

11.2. These General Conditions of Sale may be modified and / or supplemented by QUARTIER LIBRE SAS. In this case, the new General Conditions of Sale will be posted on the website www.qlcollection.com and will apply immediately for any new reservation made on the website or by telephone.

12. Applicable law - dispute resolution

The Contract is subject to French law.

The CUSTOMER is informed of the possibility of resorting, in the event of a dispute, to a conventional mediation procedure or any other alternative method of dispute settlement.

The CUSTOMER may in particular refer a court conciliator free of charge. The list of court conciliators is available at the following address: http://www.conciliateurs.fr/.

DESCRIPTION OF SERVICES

The following services are included in the price of a reservation (the rates are inclusive of VAT and are only valid for the dates and the number of occupants provided by the customer):

Apartment accommodation corresponding to the type of apartment chosen when booking and including the following services:

– Access to television channels, as well as a bouquet of international channels. The list of accessible channels is subject to change at any time (in particular depending on changes in the catalogs of broadcasters);

– Internet access (Wi-Fi);

– A Nespresso coffee machine, as well as Nespresso capsules;

– A water bottle ;

– Cosmetic products;

– The possibility of requesting the installation of a cot in the apartment (by making the request in advance, subject to availability).

Access to the common area of ​​the residence allowing access to the following services:

– Snacking throughout the day, hot and cold non-alcoholic drinks.

– Access to Wi-Fi Internet;

– A concierge service provided by QUARTIER LIBRE staff (for booking restaurants, shows, transport);

All other services or supply of goods are not included in the price of an overnight stay and will be invoiced in addition to the CUSTOMER and in particular:

Breakfast ;

The à la carte offer;

Champagne served in the apartment;

A laundry service;

The parking ;

Tariff scale invoiced to the CUSTOMER in the event of degradation / deterioration or if objects and / or furniture are missing in the apartments and common areas

12.1 The degradations mentioned below will be invoiced according to the applicable tariffs reproduced in the table below (these tariffs are intended to cover the costs incurred by QUARTIER LIBRE to repair the observed degradation).
